Terms of Use of VK Dating App

The Service Administration provides you with access to use of the VK Dating Application (hereinafter also referred to as the Service), the functionality of the VK Dating Mini App and the Mobile Application by providing remote access to them via the Internet on the terms and conditions that are the subject of these Terms of Use of the VK Dating App. In this regard, you need to peruse these Terms of Use, which are considered by the Service Administration as a public offer in accordance with Art. 437 of the Civil Code of the Russian Federation.

Terms used in these Terms of Use
1. VK Dating App (or Service) - a service designed for Users’ dating. This term is used to refer to Mini App and Mobile Application altogether.
2. The Company (or the Administration) - VK LLC. Location address: 125167, Moscow, Leningradsky Prospekt, 39, bldg. 79, OGRN 1027739850962, INN 7743001840, which is the legal owner and administrator of the Service.
3. VK Dating Mini App - software hosted on the VK Mini Apps platform within the VK social network at vk.com/dating, including a widget through which the User can interact with the functionality of the VK Dating App from the "Services" tab.
4. Mobile Application (VK Dating App) - software placed in application stores, including Google Play, App Store and others, providing the User with access to the Service.
5. Website – VK social network, hosted on the Internet website at https://vk.com, including its mobile applications, on the platform of which the Mini App operates.
6. User – an individual registered on the VK Dating App in accordance with the procedure established by these Terms of Use, has reached the age of 18 and has the relevant authority and legal capacity.
Status of the Terms of Use of VK Dating App
1. These Terms of Use of VK Dating App (hereinbefore and hereinafter referred to as the “Terms of Use”) have been developed by the Service Administration and determine the Service use and development conditions as well as the rights and obligations of its Users and Administration.
2. These Terms of Use are a legally binding agreement between the User and the Service Administration, the subject of which is provision the User with access to the Service use and functionality by the Service Administration.
3. Before registering in the Service, the User is obliged to be fully aware of these Terms of Use, as well as the Privacy Policy and the License Agreement of the Service located at the addresses https://dating.vk.ru/legal/en/privacy, https://dating.vk.ru/legal/en/license. The User’s registration in the Service means full and unconditional acceptance by the User of the above documents in accordance with Art. 438 of the Civil Code of the Russian Federation.
4. These Terms of Use may be amended and/or supplemented by the Service Administration unilaterally without any special notice. These Terms of Use are an open and public document posted at: https://dating.vk.ru/legal/en/terms. The Service Administration recommends that Users regularly check these Terms of Use for amendments and/or additions. Continued use of the Service by the User after making amendments and/or additions to these Terms of Use means the User’s acceptance and consent to such amendments and/or additions.
VK Dating App status and License provision
1. The VK Dating App is a Service of the VK Ecosystem. Registration and/or authorization in the Service using VK ID means acceptance of the VK Ecosystem User Agreement, which is publicly available at: https://id.vk.com/terms and VK Ecosystem Privacy Policy, which is publicly available at: https://id.vk.com/privacy.
2. The rights to the Service belong to the Service Administration. The latter provides access to the Service to all interested parties in accordance with these Terms of Use and the current legislation of the Russian Federation.
3. In accordance with these Terms of Use, the Service Administration (licensor) grants the User (licensee) on the terms and conditions of a simple non-exclusive license the right to use the Service, to the extent determined by these Terms of Use.
4. The right to use the standard functionality of the Service is provided to the User free of charge.
5. The right to use additional functionality and options is provided for a fee, unless the Service Administration provides another way to obtain it. The provision of additional functionality of the Service is governed by the License Agreement located at: https://dating.vk.ru/legal/en/license.
VK Dating App Administration
1. The Service Administration (hereinbefore and hereinafter referred to as the Service Administration or the Administration) in these Terms of Use and other special documents regulating the Service use means VK Limited Liability Company, a legal entity established under the laws of the Russian Federation and registered at: 125167, Moscow, Leningradsky Prospekt, 39, bldg. 79.
2. Appeals, offers and claims from individuals and legal entities to the Service Administration in connection with these Terms of Use and all issues regarding the Service operation, violations of the rights and interests of third parties in course of its using, as well as requests of persons authorized under legislation of the Russian Federation, can be sent to the legal address of VK LLC.
3. Any User can report content or Users that violate the Terms of Use by using the functionality provided in the VK Dating App. To submit a report, the User needs to press a special button located next to the profile of the User who uploaded controversial content or whose behaviour violates the Terms of Use, then select the report reason and press the "Submit" button. The Administration processes reports within 12 hours.
4. With regard to the operation and development of the Service, the Service Administration is guided by the legislation of the Russian Federation, these Terms of Use, and other special documents that are developed or may be developed and adopted by the Service Administration in order to regulate the Users’ access to certain functionality of the Service.
5. Nothing in these Terms of Use provides the User with the right to use the company name, trademarks, domain names and other distinguishing marks of the Service Administration. The right to use the company name, trademarks, domain names and other distinguishing marks of the Service Administration may be granted only on the basis of the written agreement concluded with the Service Administration.
Registration in the VK Dating App and User status
1. User registration is free and voluntary.
2. When registering in the Service, the User is obliged to provide the Service Administration with the necessary reliable and up-to-date information for creating of the User's profile, including name, date of birth, gender. The Service registration form may request additional information from the User.
3. The User is responsible for the accuracy, relevance, completeness and compliance with the legislation of the Russian Federation of the information provided during registration and its purity from claims of third parties.
4. After the User’s successful registration in the Service, the Service Administration assumes the rights and obligations to the User specified in these Terms of Use.
5. The processing of User’ personal data is performed in accordance with the legislation of the Russian Federation. The terms and conditions for processing User personal data are defined in the Privacy Policy of the Service.
6. After registration, the User acquires the right to independently use and determine the content of the profile for personal purposes.
7. The Service Administration does not take part in composing of the User's profile. By posting information in the Service profile, including his personal data, the User acknowledges and agrees that the specified information may be available to other Service Users.
Obligations of VK Dating App User
1. When using the Platform, the User is obliged:
  - to comply with the provisions of the current legislation of the Russian Federation, these Terms of Use and other special documents of the Service Administration;
  - to provide accurate, complete and up-to-date data during registration, monitor their updating;
  - not to provide access to other Users to his own profile or to individual information contained in it in the event that this may lead to a violation of the legislation of the Russian Federation and/or these Terms of Use, special documents of the Service Administration;
  - not to post information and objects in the profile (including links to them) that may violate the rights, interests of other persons and the current legislation of the Russian Federation;
  - to keep in secret and not to provide other Users and third parties with personal data that became known to him as a result of communication with other Users and other use of the Service (including, but not limited to, home addresses, phone numbers, email addresses, passport data, banking information) and information about the private life of other Users and third parties without obtaining the appropriate prior permission of the latter;
  - to back up important information for the User stored in his profile.
2. In case of doubts about the legality of any actions, including posting information or giving access, the Service Administration recommends to refrain from committing them.
3. The User of the Service is prohibited from:
  1. registering as a User on behalf of or instead of another person ("fake account");
  2. distorting information about himself and his age;
  3. uploading, storing, publishing, distributing and providing access to or otherwise using any information that:
    (a) contains threats, discredits, insults, damages honour and dignity or business reputation or violates the privacy of other Users or third parties;
    
    (b) violates the rights of minors;
    
    (c) is vulgar or obscene, contains pornographic images and texts or scenes of a sexual nature;
    
    (d) contains scenes of inhuman treatment of animals;
    
    (e) contains a description of the means and methods of suicide, any incitement to commit it;
    
    (f) promotes and/or contributes to the incitement of racial, religious, ethnic hatred or enmity, promotes fascism or the ideology of racial superiority;(g) contains extremist materials;
    
    (h) promotes criminal activity or contains advice, instructions or manuals on the commission of criminal acts;
    
    (i) contains confidential information, including, but not limited to, state and trade secrets, information about the private life of third parties;
    
    (k) contains advertisements or describes the attractiveness of drug use, information about the distribution of drugs, recipes for their manufacture and use instructions;
    
    (l) may result in criminal acts by misleading Users or violating their trust;
    
    (m) contains propaganda and/or political appeals;
    
    (n) or otherwise violates the rights and interests of citizens and legal entities or the requirements of the legislation of the Russian Federation.
  4. illegally uploading, storing, publishing, distributing and providing access or otherwise using intellectual property of the Service and third parties;
  5. using the software and taking actions aimed at disrupting the normal functioning of the Service and the Users profiles;
  6. uploading, storing, publishing, distributing and providing access or otherwise using viruses, trojans and other malicious programs;
  7. using automated scripts (programs, bots, crawlers) to collect information on the Service and/or interact with the Service and its functionality without special permission from the Service Administration;
  8. carrying out illegal collection and processing of personal data of other persons;
  9. using the Service in a different way, except through the interface provided by the Service Administration.
  10. reproducing, duplicating, copying, selling, trading and reselling access to the Service use;
  11. using any method to ask for and/or extort money and/or other material values from the Service’s Users;
  12. making appeals of a political and/or propaganda-based nature in any form;
  13. place other people's photos on the User's profile, as well as any items not containing a current image of the User.
  14. duplicate the User's own profile or create more than one profile.
  15. fraudulently gain access to the Premium Subscription, Additional Options of the Service or other features of the Service.
  16. posting any other information that, at the discretion of the Administration, is undesirable, does not correspond to the purposes of the Service, infringes on the interests of Users or is undesirable for placement on the Service for other reasons;
  17. send other Users at the beginning of their correspondence offers of a mass and/or similar nature to follow a link, join a group or follow a profile on social media, and/or move the conversation with the User to other communication channels and services.
4. The User is personally responsible for any information that he posts in his profile, gives to other Users, as well as for any interactions with other Users carried out at his own risk.
5. If the User does not agree with these Terms of Use or their updates, the User is obliged to refuse to use the Service, informing the Service Administration about it in the prescribed manner.
The terms and conditions for Intellectual Property
1. Exclusive rights to the Content posted in the Service.
  1. All objects placed in the Service, including design elements, text, graphics, illustrations, scripts, programs, and other objects and their collections (hereinafter referred to as the Content), are objects of the exclusive rights of the Administration, Service Users and other copyright holders, all rights on these objects are reserved.
  2. Except as provided in these Terms of Use, as well as the current legislation of the Russian Federation, no Content may be copied (reproduced), processed, distributed, displayed in a frame, published, downloaded, transferred, sold or otherwise used as a whole or partially without prior permission of the copyright holder, apart from the cases when the copyright holder has explicitly expressed his consent to the free use of the Content by any person. Reproduction, copying, collection, systematization, storage, transfer of the Content with a goal of creating a database for commercial and/or non-commercial purposes and/or use of the Content in whole or in any part without the consent of the Administration, regardless of the type of use, is not allowed.
  3. By posting in the Service the Content legally owned by him, the User grants other users a non-exclusive right to use it exclusively within the framework of the functionality provided by the Service, by viewing, reproducing (including copying) and other rights solely for the purpose of personal non-commercial use, except for cases, when such use causes or may cause harm to the interests of the right holder protected by the law.
  4. The use by the User of Content to which the User has got access solely for personal non-commercial purposes is allowed as long as all signs of authorship (copyrights) or other notices of authorship are preserved, the author's name is preserved unchanged, and the work is preserved unchanged.
  5. The User also grants the Service Administration a non-exclusive right to use, free of charge, the Content posted using the Service in public access and legally owned by it in order to ensure the Service operation by the Service Administration to the extent determined by the functionality and architecture of the Service, and to display the Content in the Service Administration's promotional materials, particularly as images in the Service interface, including by making such promotional materials available to the public. This non-exclusive right is granted as long as the Content is posted in the Service and the and extends to the territory of countries around the world. The expiration of posting term of the Content in the Service and/or expiration of the non-exclusive right does not entail the need to remove the Service Administration’s promotional materials displaying the Content (including their removal from the Internet). The Service Administration is entitled to transfer the rights specified in this clause to third parties. The User agrees that the Service Administration has the right to use functional and technical capabilities of the Service and the that ensure and are intended for displaying the Content posted by the User, at its own discretion, including for the purposes of displaying advertising.
  6. If the User deletes his Content from the Service, the non-exclusive right mentioned in clause of these Terms of Use will be automatically revoked, however, if necessary, due to the Service operation, the Administration reserves the right to keep archived copies of User-generated Content for the required term.
  7. Besides his own Content, the User is does not have the right to upload or otherwise make public (publish in the Service) the Content from other websites, databases and other results of intellectual activity in the absence of the copyright holder’s explicit consent to such actions.
  8. Any use of the Service or the Content, unless it is permitted in these Terms of Use or of the copyright holder has given his explicit consent to such use, is strictly prohibited without the prior written permission of the copyright holder.
  9. Exclusive rights to the Content posted in the Service otherwise expressly provided in these Terms of Use, nothing in these Terms of Use shall be considered as a transfer of exclusive rights to the Content.
2. Liability for violation of exclusive rights.
  1. The User is personally responsible for any Content or other information that he uploads or otherwise makes public (publishes) in the Service or with its help. The User does not have the right to upload, transfer or publish Content in the Service if he does not have respective rights to perform such actions that are acquired or transferred to him in accordance with the legislation of the Russian Federation.
  2. The Service Administration may, but is not obligated to, view the Service for the presence of prohibited Content and may remove or replace (without notifying) any Content or users at its sole discretion, for any reason or without reason, including moving or deleting any Content that, in personal opinion of the Administration, violates these Terms of Use, the legislation of the Russian Federation and/or may violate the rights, cause harm or threaten the safety of other Users or third parties.
3. The User agrees to receive, through the Services and tools of the VK Ecosystem, as well as via third-party services, electronic messages, text messages and other types of newsletters, including advertising and information content.
Functioning of the VK Dating App and responsibility for its use
1. Users are responsible for their own actions in connection with the creation and placement of information in their own profile. Violation of these Terms of Use and the current legislation of the Russian Federation entails civil, administrative and criminal liability.
2. The Service Administration provides the Users with the technical possibility to use the Service, and does not participate in the creation of Users profiles, does not control, neither is responsible for the actions or without limitation of any persons in relation to the Service use or creation and use of the User profile content.
3. The Administration reserves the right to change the design of the Service, its content, functionality, to change or complete its scripts, software and other objects used or stored on the Service, at any time, with or without prior notification.
4. The Website Administration can take measures aimed at machine recognition using artificial neural networks and removal of inappropriate content uploaded to the Service. At the same time, the Service Administration does not pre-moderate or censor User information, and only takes actions to protect the rights and interests of individuals and ensure compliance with the requirements of the legislation of the Russian Federation after receiving a request from an interested party to the Service Administration in the prescribed manner.
5. The Service Administration is not responsible for the violation of these Terms of Use by the User and reserves the right, at its own discretion, as well as upon receipt of information from other users or third parties about the violation of these Terms of Use by the User, to change (moderate), ban or delete any information published by the User, that violates the prohibitions established by these Terms of Use, to suspend, restrict or terminate the User's access to the Service functionality, at any time, for any reason or without explanation of reasons, with or without prior notification. The Service Administration reserves the right to ban the User's profile if the Administration finds that, in its opinion, the User poses a threat to the Service and/or its Users.
6. If the Service Administration has banned the User's profile, the User has the opportunity to challenge the banning of the profile. If the User did not take advantage of the opportunity to challenge the banning of the profile or was not enabled based on the results of consideration of the appeal, the Service Administration shall restrict the User's access to his/her profile. In exceptional cases, the Service Administration has the right, but is not obliged to restore the User's access to his/her profile upon the User's request to the Service Administration, if the User eliminates and confirms the elimination of the violations committed.
7. The Service Administration makes commercially reasonable efforts to ensure the operation of the Service around the clock, however, does not guarantee the absence of interruptions due to technical malfunctions or preventive maintenance. The Service Administration is not responsible for temporary failures and interruptions in the operation of the Service and the loss of information caused by such events. The Administration is not responsible for any damage to the User’s or the third party’s computer, devices, any other equipment or software caused or associated with downloading of materials from the Service or via links posted in the Service.
8. The Service Administration has the right to manage statistical information related to the Service functioning. For the purposes of organizing the operation and technical support of the Service and the performing of these Terms of Use, the Service Administration has the technical possibility to access User profiles, which the Administration implements only in events specified bythese Terms of Use.
9. The Service Administration has the right to send the User information about the development of the Service and its functionality, as well as advertise its own activities.
10. Limitation of liability of the Service Administration:
  1. THE SERVICE AND ITS FUNCTIONALITY, INCLUDING ALL SCRIPTS, APPLICATIONS, CONTENT AND DESIGN OF THE SERVICE ARE PROVIDED "AS IS". THE ADMINISTRATION DISCLAIMS ALL WARRANTIES THAT THE SERVICE OR ITS FUNCTIONALITY MAY OR MAY NOT BE SUITABLE FOR A PARTICULAR USE. THE ADMINISTRATION CANNOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM THE USE OF THE SERVICE AND/OR ITS FUNCTIONALITY;
  2. UNDER NO CIRCUMSTANCES, THE SERVICE ADMINISTRATION OR ITS REPRESENTATIVES WILL BE LIABLE TO THE USER OR TO ANY THIRD PARTIES FOR ANY INDIRECT, ACCIDENTAL, UNINTENTIONAL DAMAGE, INCLUDING LOST PROFITS OR LOST DATA, DAMAGE TO HONOUR, DIGNITY OR BUSINESS REPUTATION CAUSED IN CONNECTION WITH THE SERVICE USE, THE CONTENT OF THE SERVICE OR OTHER MATERIALS TO WHICH YOU OR OTHER PERSONS HAVE GAINED ACCESS VIA THE SERVICE, EVEN IF THE SERVICE ADMINISTRATION HAS WARNED OR INDICATED THE POSSIBILITY OF SUCH DAMAGE.
  3. THE SERVICE ADMINISTRATION OR ITS REPRESENTATIVES SHALL NOT BE LIABLE TO THE USER FOR LOSSES SUFFERED BY THE USER IN COMMUNICATIONS WITH THE SERVICE USE, THE CONTENT OF THE SERVICE OR OTHER MATERIALS TO WHICH YOU OR OTHER PERSONS HAVE GAINED ACCESS VIA THE SERVICE.
Final Provisions
1. These Terms of Use are an agreement between the User and the Service Administration in respect to the procedure for using the Service and its functionality.
2. These Rules are governed by and construed in accordance with the legislation of the Russian Federation. Issues not regulated by these Terms of Use shall be resolved in accordance with the legislation of the Russian Federation.
3. In the event of any disputes or disagreements related to the execution of these Terms of Use, the User and the Service Administration will make every effort to resolve them through negotiations between them. If the disputes are not resolved through negotiations, the disputes shall be resolved in the manner prescribed by the current legislation of the Russian Federation.
4. These Terms of Use shall enter into force for the User from the time of his accession to it and is valid for an indefinite period.
5. If, for one reason or another, one or more provisions of these Terms of Use are declared invalid or unenforceable, the remainder of the provisions shall not be affected and shall remain valid and enforceable.
